Application of the General Terms and Conditions of Sale

The general terms and conditions of sale outlined below (hereafter known as "General Conditions"), govern the contractual relationship between any user of the Movertix website and VertixOn Group®, with the headquarters situated at Calle Gonzalo de Berceo 1, 21400 Ayamonte, Spain, registered with the record Y-0432788-B, Data Universal Numbering System (DUNS) number 466826576 and a registered European brand with the number N0358645. These general terms and conditions are the only ones applicable and replace all other conditions, except in the case of express written consent. Movertix may be occasionally obliged to modify certain provisions of its general conditions. Therefore, it is necessary to re-read the terms and conditions before each purchase on Movertix.com site. We consider that by confirming your order, you have read and accepted our general conditions of sale without reserve.
All orders placed by the customer imply the full acceptance of the present general conditions of sale. Any clause accompanying a customers order, or any other document which is in opposition to, or which adds a new element to the present general conditions (such as the general conditions of purchase by the customer), will not be accepted by Movertix.

Prices and Discounts

The products sold by Movertix are billed in Sterling Pounds (GBP) or in the choosen currency and without taxes (under the condition that you provide us with a conforming inter community VAT number: see Article 19 of this document), at the price quoted on the day of the registration of the order by Movertix. It does not include delivery charges, under the condition that the delivery is not prolonged by the Client. Movertix reserves the right to modify its price at any time and in compliance with current laws. For the European Union, prices shall appear in Euros on the Site as well as in the currency of the destination country. In certain cases, products supplied in a currency other than the Euro, and with a trading variation superior to 3%, may have that variation reflected on the date of invoicing. After acceptance of Movertix’s present general conditions of sale, and acceptance as evidenced by voluntarily reading this Terms and Conditions the Client approves the listed conditions. All Movertix clients can benefit from discounts in large quantities orders, with the discount rate varying in relation to the product ordered, please contact us.

Payment Conditions

Except in special conditions requiring a special agreement, Movertix payment conditions are as follows:

  • by Debit or Credit card (American Express, Mastercard, Visa, Maestro);
  • by PayPal;
  • by Wire Transfer (grace period of 24/48h);

Invoices

All the orders placed on Movertix will be processed by VertixOn Group® Accounting department up to 7 (seven) working days after goods delivery and it will be invoiced through one of VertixOn Group® holding companies. Movertix won't process any invoice without a VIES VAT number validation. Invoices will be available in the customer area of our website.

Availability of products

Our products are offered while supplies last. The information on the availability and stock of our products comes directly from our logistic centers and is daily updated at 2am. We cannot be held responsible for any error or exceptional modification. In the event that a product is not available after you have placed an order, we will inform you by email as quickly as possible so that you may cancel your order or change for another product.

Forwarding - Delivery - Delivery Charges

Upon receipt of your order, we recommend that you check to see if the products delivered conform to your order or indicate if they are damaged, where appropriate, when you sign for your delivery. Movertix decides on the mode of delivery except where if specially indicated by the client. The risks associated with delivery are clients and shipping company responsibility.

The client can request an EXPRESS delivery (an order forwarded before 2pm will be delivered in 24/48 hours). Chemical products are an exception to the EXPRESS delivery option. Standard delivery usually takes 3-5 working days following the confirmation of your order. Delivery may take longer for areas that are not easily accessible. These options apply to the U.K only.

The Client must, as of reception, inspect the parcels within the legal timeframe. Please note, conditions such as "acceptance conditional upon verification" or "acceptance conditional upon opening of wrapping” have no legal value with insurers or with transporters. It is the Client’s responsibility to provide proof of missing or broken articles.

Movertix will strive to respect the stated delivery times, but cannot be held liable for interest and damages because of late delivery and cannot accept the cancellation of an order on that basis. An order made for goods not in stock may be the object of a longer period of delay or a cancellation. If you not receive your order within the given time frame, you must file a report with Movertix no later than 14 calendar days following the dispatch of the parcel. An enquiry will be opened with the carrier. This may several days. Please enclose proof of ID and a sworn statement stating the delivery address and declaring that the parcel has not been received. Movertix is unable to give details regarding further action while the enquiry is underway.

Claims

If the products received do not conform to the invoice, the Client must advise Movertix immediately, or at the latest 3 (three) days beginning with the date the order was received. A copy of the invoice must be attached to the Client’s claim. Any claim based on the quality of a product must be accompanied by a specimen of said product containing the flaw as well as a sample still in its original packaging with the appropriate reference numbers for identification. No claims will be processed that do not adhere to the above conditions.

Returns or Cancellations

In general you have 14 calendar days after receiving your order to return, exchange or cancel, from the day of consignment, to receive the order back. All products must be returned in perfect condition, labels intact, unopened along with any stamps or marks required for resale, carefully packaged, with all of their accessories (e.g. phones, cables, user guides, etc.) and without any modifications to their reference and serial numbers. Returns are not accepted for the reason "the customer does not like the product" or "the product does not meet customer expectations", ie any type of return that is not related to the product failure or to an error made by us. Products must be returned to one of VertixOn Group® After-Sales Services by registered mail, regardless of whether they are the subject of a refund, exchange or a return. If a product is returned without prior written authorization from VertixOn Group®, it will be automatically sent back to the Client at their expense. All the refunds are processed within 24-48 hours after goods reception and inspection. All virtual products (licenses, software...) can't be canceled, returned or refunded, due to Manufacturers restrictions. Due to hygiene reasons we may not offer a full refund if headsets, headphones or earpieces have been handled in any way or worn.

Remember! We do not accept the return or exchange of Apple products that have been unsealed and/or activated. The customer must manage the incidents of these products directly in Apple's warranty.

Guarantees

All products sold by Movertix by VertixOn Group® comes with a 3-year "manufacturer warranty". The term of these warranties can be extended, and coverage is defined by the product purchased and the brand.
Repairs to products, whether they are covered by warranty or not, are guaranteed by the manufacturer or certified workshop. Whether the brand has operations in the UK or is represented by a third party is irrelevant. Defective or faulty products must be returned directly to manufacturers or certified workshops.

Should you be unable to contact the manufacturer, you may return your product via standard post (or carrier) to the address given on your returns coupon. Returned products will not be accepted at the VertixOn Group® head office.

VertixOn Group® agrees to arrange repairs with its suppliers. Whatever the problem, you must return your product along with a copy of the invoice, the warranty card (included in the original box) and the returns coupon. Products are returned at the customer’s expense.

In case where the warranty is not applicable for the reparation, the manufacturer will quote a price for repair. For any information concerning the After Sales Service, our services are available from Monday to Friday from 9 am to 6 pm: see our Contacts page.

Product warranties sold by VertixOn Group® do not cover:

  • replacement of consumables such as batteries, light bulbs, fuses, antennas, headphones, microphones and recording heads...);
  • incorrect or inappropriate use of products. Please read the user manual supplied with your product carefully;
  • malfunction due to accessories such as power cables;
  • defects and consequences following repairs by a person non-certified by VertixOn Group®;
  • defects and consequences due the incorrect use of the product, e.g. commercial purposes;
  • defects and consequences due to external causes.

Please note that warranties do not apply to repairs for damage due to external causes, e.g. accidents, shocks, power spikes, lightning, etc, or to the customer’s incorrect use of the product, e.g. product not installed in accordance with manufacturer’s instructions, detrimental use of product, use of product for commercial purposes, use of unsuitable peripherals, accessories or consumables, etc.

In all cases, VertixOn Group® will not be held responsible if the manufacturer refuses to honour the warranty. In such a case, the manufacturer will provide a quote for repairs. Administration fees may be charged by the manufacturer if the customer refuses to pay for the repairs specified in the quote. Should the customer accept the quote, payment for the total amount of the quote should be sent to VertixOn Group®.

Publicity and Display goods

Promotional and display material (catalogs, posters, etc.) may be given to customers for use by their company, and may only be used at the addresses authorized by Movertix for the sale of its products. The customer must not consider themselves as Movertix agent, as this would imply that they are acting on behalf of, or under the authorization of Movertix management team. The terms "Movertix agent", "Movertix dealer" or "Movertix" must be used in such a way that a third party will not be led to believe that Movertix has an interest or a responsibility in the management of the customer's business. The brand "Movertix" or "Movertix.com" cannot be used without prior written authorization from VertixOn Group. Customers who wish to advertise must consult the concerned Movertix department beforehand to receive their approval.

Trademarks

Trademarks distributed by Movertix are protected by current laws and international conventions. As a consequence, neither Clients nor third parties can use trademarks without the express written consent of the trademark holder. It is understood and agreed that the acceptance of the present General Conditions is not in any way such an authorization.

Insurance

To cover the risk of loss, of theft or other damages during shipping, some of the products may be subject to, each party shall make provisions to cover such losses with its own insurance company.

Content Information

Movertix reserves the right to modify at any time the information and commercial offer presented about: products, prices, promotions, commercial conditions and services provided.
Every day we strive to ensure that the information presented on our site is free of typographical errors and whenever this occurs we will correct it as soon as possible. In case the information presented does not correspond, for any reason, to the product characteristics, the Customer should in doubt confirm the EAN code, look for our reference on the official website of the brand, and confirm the specifications before making his purchase, Movertix cannot be held responsible for any errors in product descriptions.

Despite our constant efforts to check and update, some products in our catalog may be priced incorrectly, so we always check prices when ordering. If the price of the product is lower, we will refund the difference, if the price is higher, we will inform the Customer and await his decision to accept or cancel the order.
All promotional campaigns have limited stock and are exclusive to online marketing.

Liability limits

No liability will be accepted for loss or damages, direct or indirect, whatever the cause. In no case will the Client, for any reason, withhold funds from an invoice for an incomplete delivery or for defective goods.

Ownership of Property

Movertix remains the owner of the goods delivered until the payment is made in full. A promise of payment is not considered full payment until said payment has actually been processed. Any damage caused while in the possession of the client, should said client not have paid in full, is his responsibility. Should the Client deliver goods to a third party that has not been paid for, he is advised to immediately inform Movertix.

Sale Cancellation

In the case of non-payment of a delivery after the deadline, the sale shall be considered void 8 (eight) days after notification by registered letter with proof of reception. Movertix will claim the concerned goods without delay, with all associated fees and risks being the responsibility of the Client. Returning the goods does not negate the possibility of interests and damages.

Late penalties

In accordance with current law, any sums paid after the due date of the invoice as per article 3 (three) of the present document, will be subject to late fees. These fees will be calculated at one and a half times the bank rate and will be applied retroactively to the date of delivery of the products.

In the event of default

Should payment not have been made in full as of the stated deadline, all outstanding sums, regardless of deadline, will be requested immediately.

Applicable law - Attribution of jurisdiction

In the event of a failure to amicably resolve payment, all litigation involving Movertix and its Clients will be settled exclusively in the Courts of Marbella, Spain with the applicable law being Spanish law. Some products sold fall under the domain of strategic merchandise and cannot be exported without express written consent from Movertix.

Conditions permitting eligible for payment without VAT

The Site is reserved for professional clients wishing to purchase products that are directly related to their activity and who have opened an account beforehand according to the following conditions.
When the client first opens an account on Movertix.com, they agree to provide the following information when placing their first order:

  • a valid Company information;
  • a valid VAT number;
  • a professional Email address
  • a landline telephone number (place of work or home) on which they can be reached during normal opening hours;

In addition to this information, the client also agrees with the following terms, for each order:

  • supplied VAT number belongs to your company;
  • the transactions made on your account will be carried out by your company;
  • all the other information you have provided to date is correct and accurate and that you will inform us of any change or update this information;
  • Movertix reserves the right to request additional information and to request confirmation of the validity of the information regarding your account in agreement with the competent authorities and how the law authorizes. Shall allow the Movertix to gather and obtain this information from the competent authorities. I.e. should accept to forward to Movertix all the information about your account since the first demand of Movertix;
  • Movertix will cancel the order if the VAT number provided proves to be invalid or if the requested documents are not supplied. Note in General, VAT is no longer applied to the sale of the product. If any of the provided information is not accurate with the intention of avoiding VAT may result in legal action against the person responsible.
